Okey.. recently, i got pulled over for speeding only 81 on 65 limit highway.. well as i prepared my self with an ID before the cop stood next to me, he asked me why i reached down and i said for ID, after getting a ticket, he decided to check the car to see if he can find anything illegal.. even when i told him i didnt have anything.. my question is Does my reach for ID a "reasonable doubt" for the cop to search my car?? i mean seriously it was embarassing standing outside at 2:00am in the middle of the road with two troopers... also, He checked both of the passangers ID.. i mean foreal.. can they really do that or can i argue that he was looking for an illegal immigrant or something??? you know cuz it was 3 asain female in the car.. I dont know if i was treated fairly so i wanna ask.. if anyone has treated the same way or not??? let me know...

this is my response:
well the reason i said only 81 was because we were taking a road trip and every body was drving beyond the speed limit and average was 80 to 85 foreal.. And no i dont watch cop shows or much TV...Another thing...I m grateful for cops and for what they do... I have never been pulled over in my life before being a driver and i have been driving for more than 5 yrs and i am just suprised by the procedure. This is just a question and your answer is appreciated.. whinning is not my thing so this is real what i think :>

According to my understanding, the officer would only have rights to search the area where you were reaching, not the whole car. Reaching for an ID is a valid reason to be reaching (even though you should still wait for the officers acknowledgment of such an action). It doesn't sound like the officer had sufficient probable cause to search.

It's 2 AM and your reaching around in your car. Your lucky you weren't pulled out at gun point, foreal. He can ID everyone in the car to check for warrants or age since its 2 AM, foreal. Reasonable doubt is an argument in court, foreal. The trooper observed furtive movements by you which gave him probable cause to search the area within your reach for weapons, foreal. You were treated fair, foreal.

Only 81 in a 65? you're lucky, so far.
Don't make any quick moves in front of the detaining officer- makes them nervous.
Cops will ID everyone in the car; what if you're driving dangerous criminals to their next evil deed? He doesn't know. Were you ticketed?
All in all, just a routine traffic stop.

Haven't you ever watch Cops.You do not reach for your divers license untill they ask for it.They want to know where your hands are at all times.Remember their lifes are at stake as too many police have been gunned down at routine traffic stops.Yes they had probable cause when you decided to do things your way.So quit your whinning and be greatful that they are out there protecting us citizens and laying their lifes on the line

"only"81 in a 65?? You are damn lucky it wasn't me that caught you. I'd have by-passed the traffic ticket and cited you for Careless and Neglegent operation. Anything over 15 mph over the speed limit is C&N. Quit whining and count your blessings.

He probably thought you were reaching for a weapon so he searched your car for his own safety. That will probably hold up in court--it's pretty reasonable.

Also, just so you're in the know, the term is "probable cause" not "reasonable doubt." :)

That was a routine traffic stop. Sorry, but if you hadn't been speeding you would have avoided the embarrassment entirely.
