I'm the closing shift manager at a Wendy's in New York. There is this 19 year old kid that's always giving me a hard time. Every chance he gets he does something to cause me grief. There are 2 other guys that work with us that he hangs out with. He got in an arguement with one of the guys, the other one is his best friend. He told his best friend he better not talk to the other guy, anyways one night we were all working except for the jerk, we will call him Bob. Bob parked down the street and spyed through the window and saw the 2 of them talking. When his best friend went to leave Bob was outside waiting and yelled at him for talking to the other guy. This is just some of the stuff he does. He has went to the police many times to file complaints about my husband saying he's harrassing him. My husband has talked to him only because Bob gets me so upset. He lies about me to get me fired and I dont know why. My boss wont fire him and I dont know why. She knows he harrasses me.

I know hes upset because he was supposed to get the positon I have. He underminds my authority and doesn't think he has to do what I say. My boss has moved him from my shift so we don't see eachother anymore but I feel this isn't enough. Why hasn't she fired him yet? Is there anything I can do?

You need to take DETAILED notes about his harassing behavior (document everything you can remember up to this point). This is critical because you will need proof. If you can get witnesses to sign it ... then do! Your boss is an idiot because if this guy hurts someone or causes something really bad to happen she will also lose her job (esp. because she knows of his behavior) and could be sued along with him and Wendy's Corp. itself!

Never be around him alone and if he comes in on his day off you can certainly call the police and press harassment charges. This kid is psycho and you need to watch out for yourself. I would keep your husband away at this point, because it will only make things worse and this kid sounds like he could snap.

Since your boss won't do anything you need to go over her head. This is a serious situation and I wouldn't take it lightly. Go to her boss or the District Manger (or contact Wendy's Corporate) with all the documentation and get this taken care of. Wendy's is an "at will" employer and can fire any employee if they so desire. This guy needs to be LONG gone!

This guy seem like a time bomb about to go off i would call the corperate office if you cant seem to get your bosses attention on how serious this is. I also would call the police station and ask them if this spying thing is considered stalking I would also consider calling a attorney to find out what the laws are for harrasment or better yet call your DAs office they can help

Christee is exactly right, document everything he does, also document the dates and times you talk to your supervisor. If you do not get satisfaction with her go to the next level. Be careful these whackos are capable of anything nowdays.he sounds like one foot over the edge there. There are strict laws on workplace behavior nowdays and Wendy's will have to do something or you will have one hell of a case against them. Believe me Wendy's does not want their name in the newspaper over this kind of nonsense.

I've been in that line of work on and off since 86' and you'll hear the same thing, keep lots of notes, report to superviser and if still continues, go over your bosses head and if not satisfied go to next person and so on. that's why it's called CHAIN OF COMMAND!!!!!!!! That's if you want to stay with the crappy company. I use to work for them. If all else fails, look somewhere else, and QUIT!!!!!!! Because stuff like that ruins the business faster then 1 may think. APPARENTLY your boss DOES NOT CARE AND IS STUPID!!!!!!!!!!!!!!

If Wendy.s has a harrassement policyconfront your boss with it otherwise go to theNLRB(national labor relations board).

why do you put up the fight? this kid will get his one day. hopefully he meets me so I can beat his *** but until then.

don't give him the power. leave, it's just wendy's. no offense.
put in a request for transfer and do not tell anyone about it. people gossip.

file sexual haressment against him as well the boss as well he didnt take legal steps to fire him this is law. my opion?
