I don't think so, but isn't she a bit young? =/
Anyhow, please use protection regardless.

Yes, they can. If the girl is under the age of consent (18) it's considered satutory rape, even if she agrees. There was a 17 yr. old kid who got 2-5 yrs. recently in the U.S. over a 15 yr. old girl though she consented. Her parents didn't like him & they kept sneaking to see each other so they took him to court.

Here's another thought I tell my son. No birth control is 100% and if she should get pregnant & keep it he'd end up paying child support for the next 18 yrs. before he was even old enough to get a full time job. Some states are getting so strict they'll require the male to work so many hours a week at various jobs they'll provide with all the money going to the child's mother or to the state to pay them back for the welfare they give the mother.

Another thing if she got pregnant she could cry rape & he'd have a heck of a time proving otherwise. It may seem everyone is doing it but they're taking an awful big risk with their future for a moment's pleasure. With the laws the way they are today, it's all stacked in the girl's favor. Instead of improving the laws that victimized women they only changed victims.

A friend had a son who had to go to court because he was backing up to get in line after a fire drill & accidently touched a girl's breast & she accused him of molesting her. It was thrown out of court once there was no witness with so many standing around. But he had to suffer the humiliation of having a juvy record though he had never been in trouble before & others teasing him. It's just not worth it no matter how much your hormones rage.

YES!

And vice versa, if the parents so choose to prosecute.

Depending on the state, the law is anyone under 17 or 18 is not allowed by law to consent. The thought is that they are not mature enough to make proper decisions.

Someone who is 12, does not have the maturity to decide whether or not they should have sex. In my opinion, they do not have the maturity to be left at home alone for any extended period of time. This is not the simple times of our great grandfathers' any more. There are so many more dangers out there. In 12 years no one can have the experience to know them all. Especially when it comes to sex. They cannot know all of the dangers of sex and diseases. Even though girls are maturing earlier, not every girl is. Puberty still does not usually start until 11 or so. Just because your body is becoming an adult, does not make you one.

But, to reanswer your question, YES, anyone under whatever the legal age is in your state can be charged with statutory rape. It does not matter if it is the boy or the girl, or even if they are both under age.

I think having sex that young should really be out of the question. But, no you can't get in trouble. Every states laws are different when it comes to ages. But since you are both under 16 and less than 4 years apart you have nothing to worry about.

no, I am sick of everyone telling other people when they can and cant have sex, mind your own ******* business. I started having sex at 13 and thank god I did, it was the best sex I have ever had and enjoyed it immensely, I cant be the only one in the world that has felt this. we were having sex about 5 times a day, morning and night plus a few quickies through the day to keep us going. these days at 43 it takes ages just to get a ***** and the sex is average at best since my wife of 20 years' ***** is loose after giving birth and her breasts don't have any bounce at all. so thank god I had all my good sex as a young teen and I say **** all of you who say otherwise

A 12 year old can not consent to sex and neither can a 14 year old. You have to be 16 in most states in order to have sex.

It's called statutory rape and can land him in JD until he's 18.
I had a 6th grade student get impregnated by an 8th grade student.
The boy went to jail. The girl had the baby and then another one before her 8th grade year. Once it starts, it's hard to stop.

The boy went to jail. The girl dropped out of school during the 8th grade to take care of her children.

Definitely a BAD IDEA all the way around.

yes. you're both underage. if mom and dad find out, the boy can be prosecuted as an adult depending on the state. there's no point in having sex at that age cuz neither of you will enjoy it. half way decent sex doesn't start for most boys til about 18, 19..and for girls...much later. your body is still developing. go for a walk around the park...buy her flowers... work on being the most romantic boy that she'll ever meet in her life. it's better to be remembered as the boy who stole her heart instead of the boy who took her virginity...and it wasn't good anyway!!!

do u live in aus?? if so no you cant. well not legally. legal age is 16, but because your both underage its not illegal. morally?? i think you should be both kicking ourselves in the ass. 12years old is way way way too young to be having sex. i doubt she and you even fully understood what you were doing. there is also a chance she could be pregnant. at 12, she may not have had her first period (therefore not even fully developed) but can still fall pregnent. you shouldnt have done this you are way too young. so yes you should feel that you are in trouble.

I don't think you can legally be in trouble, but you should take blame for being stupid and careless with your life. You shouldn't be having sex till you are 18. She's 12 okay! She should be playing with toys and friends. Not a person that is 2 years older then her, and probably very persuading I bet. too. Please be responsible.

relies upon on the place there stay and the criminal age for sexual consent and if the 22 year previous had any criminal reign over the newborn which includes a school instructor or a step-discern ( the regulation says if the newborn has a sensible concern of being abused, ignored, or taken care of unfair in the event that they do no longer adjust to the adults request then they carry a criminal reign over the newborn)
