Instincts are non-learned, inherited (genetic)patterns of behavior generally ensuring the survival of a species. Common examples are spiders spinning a web, maternal "instinct"like nest building, migration patterns of animals, social behavior in insects, etc.
As we ascend the phylogenetic scale from the most primitive to the most complex ,animals tend to depend more upon learned behavior than instincts. Humans, for example (assuming that we are the most advanced!) rely very little on instinctual behavior and rely for the most part on learned (i.e. cerebral) behavior.
Many instincts in humans in fact lead to conjecture. Some possible instincts in humans that I can think of are at birth ; the sucking response (to be nourished), the grasping response , and a walking motion of the feet.
This question transcends the disciplines of biology and psychology.

Instinct is the inherent disposition of a living organism toward a particular behavior. Instincts are generally inherited patterns of responses or reactions to certain kinds of stimuli. Instinct provides a response to external stimuli, which moves an organism to action, unless overridden by intelligence, which is creative and more versatile. Since instincts take generations to adapt, an intermediate position, or basis for action, is served by memory, which provides individually stored successful reactions built upon experience. The particular actions performed may be influenced by learning, environment and natural principles. Generally, the term instinct is not used to describe an existing condition or established state.
Examples can more frequently be observed in the behavior of animals, which perform various activities (sometimes complex) that are not based upon prior experience, such as reproduction, and feeding among insects. Other examples include animal fighting, animal courtship behavior, internal escape functions, and building of nests.
It is debatable whether or not living beings are bound absolutely by instinct. Though instinct is what seems to come naturally or perhaps with heredity, general conditioning and environment surrounding a living being play a major role. Predominantly, instinct is pre-intellectual, while intuition is trans-intellectual.

In kind of an analogy, it's going through a red light just because everybody else is doing it. Somebody sees somebody doing something wrong, and they think they can get away with it too. There are positive aspects of instintual behavior too.

depends on the level of consciousness I think ..most sober people will avoid a fight when someone insults them but the same person when drunk may be provoked and instictually wish to smack someone out. I don't know a lot about it but there are different mind rhythms ? alpha and beta..and others .. like when we're fully awake - using our learned behaviour - or more sleeplike when we revert to instinctual behaviour..
