Here the first & foremost thing which we have to see what is the intention of the person inflicting such threat to another person. The very fact in absence of Mens Rea or criminal intention to commit such offence we cannot hold the person threatening another for the offence of criminal intimidation. Any casually spoken words complained here as amounting to any threat during the conversation between two friends who otherwise have no enmity amongst them will not be taken to be done with a criminal intention to actually commit such offence which looks to be threat by the person to another. This can be explained by another example where a mother in order to discipline her children in anger tell them of physical harm to them doesn’t amount to criminal intimidation as in such a case the real intention is not to actually inflict the physical harm but to discipline them. In the given case this girl with an intention to get her things done or to show her anger to her boy friend just to emphasize her anger used such words regarding killing him will not amount to criminal intimidation as defined under section 503 of the Indian Penal Code.
