My transmission man will clean the case, but will not paint it.

It does not need to be painted. It is up to the shop to choose if they want to paint it or not! Some shops will paint them, some will not. If the same shop is rebuilding and installing the transmission, they most likely will not put a sticker on it. If it was rebuilt by either a factory authorized re-builder, or a company that supplies rebuilt transmissions for other shops to install, they will usually have some sort of identifying tag!

That would all depend on the shop that did the rebuilding, the local shop I use for my fleet vehicles paint their rebuilds black. As for a mark saying "Rebuilt" that would also be up to the shop, some mark the trans as such, other places use a mark that they know about, so later they can tell if it was their rebuild or not.
So if you are buying a trans from someone and they are telling you it is a rebuild, you would just have to take their word for it, because there might be nothing about the trans to let you know. See if they offer any kind of warrantee (in writing) that you can return the trans for refund or replacment before you purchase it.

Many states require it be marked to distinguish it from a new one, but a sticker is fine. Painting it seems like an unnecessary expense.

don't know about the silver part as mine is black but it does have a sticker saying rebuilt
