I guess the first question would be is that if you feel that way about your husband then why are you still married? But with your sister as power of attorney she still needs to start eviction process through the city. That's the legal way to do it it's very hard to get someone to just leave. But if you have concerns your sister might want to get your personal belongings that are left. Next day air the keys to your car so she can get it without having to try to get them from him. After your things are gone let her inform him he needs to be gone because the eviction process is happening. When it's time the police will evict him. But do not start eviction until your things are gone because he will get a notice of the process and if he's that bad he could destroy your things and run off with everything else. Your sister might go to your house scan the situation and mark everything in her mind that you want and then just have guys show up in a truck and put your things in storage it should be safe until you get home.

My guess is you have to file for legal seperation or divorce before the pre-nup goes into effect. His name on the utilities will have to changed immediately and he probably won't be paying them.
With your power of attorney for property, she can oversee the things that are in your name only like possibly the car. If you have given him approval to live in the house and now want him out it may take the police to enforce this.
Have your sister consult an attorney for you, he or she will be able to get the forms together that are needed to set this all in motion.
Good luck and I hope your future choices turn out better.

You need to get an attorney and file for divorce. In the petition you can request that you have exclusive use of the residence and that should get him out. However, if he is there as a legal resident, then he may not have to move without a court order!
Get an attorney in NV and have them ADVISE you of your legal rights.

go to jag and they will assist you with this matter. I am not to familiar with Las Vegas laws dealing with domestic issues. If you have a prenuptial it will only goes into effect during your divorce process. I am thinking that Las Vegas law will over rule the power of attorney that you given to your sister to kick him out base upon that he don't have a place to stay. Your better bet is to talk to Jag and let them guide you through this problem. good luck

Sorry, your prenup probably doesn't mean squat until you file for divorce. Until the minute you file divorce papers, you are legally married, and he you probably can't evict him. I'm not sure if you can file for divorce by proxy (having your sister file for you after you give her your poa). if you want him out, you should really call an attorney who is in LV

You have a prenup, and if you want to enforce it, then DIVORCE him. If the house was yours prior to the marriage then you can throw him out.
I have to wonder why on earth you would put his name on anything that belonged to you prior to the marriage....
At any rate, you need to ask an attorney for specifics.

I would try that and if it does not work, either have your sister move in and take over, or contact a lawyer she can work with on this for you. You do need to get the bum out and do it before he gets caught with drugs in there and they take the house.
Good luck
