I don't understand why people don't have to pay some fine, do community service, or something if their partner has prove that their cheating. Where is the logical in this. Its illegal to be married to more than one person at a time but if a married person cheats then its okay. I just don't get it. Its like people have to put some type of punishment in their prenup or something.

I agree with you!!! 100%. I've never been in this situation but I think that there should be some kind of punishment. There are too many bad things that come from it. The non cheating spouse looses so much, kids are put through alot, alot of times parents do not get over the hurt, and are afraid to try again leaving kids half of America's children in single parent households, which yes some may be better off in the long run, but they still have emotional problems etc. Why should the non cheating spouse have to re construct their lives due to the cheating spouses bad decisions? Some people have to get new or different jobs to adjust to shared custody of children, you are on a single income, you may need to pay for counceling. Yes I think you have a good idea with this punishment thing!

Jason why did you marry this person in the first place if you have to sign a pre-nup then you must of had some reservations. There is a punishment its called divorce its a final solution. By the sounds of it you just want justice and perhaps some honesty. Dont look on this as a bad experience just look on it as an opportunity to learn no matter what the outcome.

You are an idealist but in reality you have to take a good look at man as a beast of reasoning and try to understand what is the framework and context of marriage.

When was it truly enforced? For what reason was marriage and fidelity put forward in the fist place?

In some states it is illegal to commit adultery, however the prosecutors are too busy with rapists, murderers, child molesters and drug trafficers to worry about what goes on in someone's bedroom. Or would you rather they let all the murderes, rapists, child molestors and drug trafficers OUT of prison so that all of those who commit adultery can fill up the cells?

There is a penalty for it, it's called adultery and it's against the law. A judge will favor you in divorce settlements if you can prove your spouse was committing adultery.

Well, in most cases the cheater loses his or her spouse, lifestyle, and the respect of their families if caught. I would say that is punishment of a sort.

Grow up already!
It's life deal with it. It's not the end of the world people get their feelings hurt they grow a tougher skin and move on.
I think we have enough laws on the books that invade our homes don't you?

in some states you can sue the outside party if they knew the person they where with was married
