My son bike was hit by a car, about a hour or so ago, while he was trying to cross the street, he is fine, I called the ambulance and we just left the emergency room, and I am home now, and he is trying to fix the front tire, he's 7 what should be my next move? and My neighbor turned against me, and sided with the drivers family, my son, and his friends say the lady was driveing fast down a one way street, and he had looked, both ways, there were 5 of them, plus his 9 year old brother, but my neighbor say's he was in the street, and told the police that as well, plus was talking with the drivers family It's not money that I was after because I myself went to the driver after I saw my son was ok because she was so frayed, but now I am angry, and my son say's who is extremely smart, and gets all A's in school, and can read as good as any adult, say's I did not make a mistake the driver did.

OBTAIN A POLICE REPORT, seek compensation! for your childs bike, pain and suffering and such. BUT the only way to truly have a case is to get a police report.

I don't know if your kid is at fault or not.

But your kid is fine. So if you sued you would not collect anything. What do you have to gain by proving it was the drivers fault.

I think you are better off NOT blaming the driver but using this as a teaching oppertunity to discuss bike safety with your son. Odds are both were partially at fault. And you can use this as an oppertunity to discuss what your son should be doing and explain that he needs to be careful because even if it is the drivers fault - bike + car = bike rider hurt, car driver cleaning blood off of front hood.

So I would be thankful his is safe and use this to make sure it stays that way.

If he is fine, what is the issue. The world is sue happy and we need to come to the realization that there is more to life than making her life difficult. Had there been an injury, it would be different. As you said, she was frayed. But... She should fix the bike though. Inexpensive compaired to medical bills that could have accrued. Plus, its the right thing to do.

When your son is riding his bicycle, he must obey the traffic laws. The same ones the driver must obey. What it comes down to is, "Who had the right of way?". If your son did not, then he is legally at fault. If he did, then the driver is at fault. Go to the intersection and take photos of it. Note who had the stop sign, etc. Take this to an attorney if your son had the right of way. That is something you can determine for yourself, without the attorney.
