My parents went through a divorce in Ohio in 2000. My father got full custody of me and my old brother, I was only 6 at the time. After we moved to North Carolina and then to Arkansas. The mom moved to California and then Georgia. What I want to know is the legal age to decide my parent, my father told me 18, but my mom 14. I am 14 right now, and I want to live with my mom, since I've gone 8 years without her. My mother can't afford a lawsuit, so I want to make sure I have legal rights. And if the age is 18 then how do I get emancipation?

The age to decide who you want to live with is 14 you can look up in your phone book for magistrate courts and talk to any magistrate judge. Or call 411 and ask for the city you live in for a magistrates phone number. Your dad just probably doesn't want to loose you having you for so long, just let him know when you find out for certain on your own that if you love him tell him so he may just need reassurance he isn't gonna loose his little one forever.

It is 18. We went through this with my step son. You can move to either parents house if your parents agree, at any age, but if your father believes you are better off with him, the courts would have to have a very good reason to go against his wishes. It's about more than what the child wants and more to do with what the child needs. That includes mentally, emotionally, and physically.

To be emancipated, you have to prove that you can provide for yourself, on the same things........ That you are mature enough to be on your own, you are financially able to provide for yourself, you have the ability and understanding to pay your bills and do what needs to be done to survive on your own, and so on. It's not an easy thing to do (and at 14 pretty much impossible since you can't even have a job in most places until you turn 16). It's not something you can do just to move in with your mom. It's something you do when you want to be on your own.

My grandchildren had the right to live with which ever they wanted at the age of 13.They also wanted to live with their Mother. that was 9 years ago.I think you should call a Lawyer.As you said your Mother can't afford a lawsuit.At 18 You are on your own.I should not have clicked on your question.I thought I could be some help.The other folks that answered have told you right.Look on the web for a suite.I'm sure you can find one there with the right answer.Good luck.

I will go with what your mother has said. Go down to the court house and talk to a county attorney and ask him how to go about changing your living status. They will direct you to the right person to talk to. You can go to children's court and ask for assistance.

Legal age to emancipate in Arkansas is 16.

Depends on the state, In Texas it is 12

There are usually Child Advocacy Centers in towns nowadays. Try getting ahold of the closest one near you and call and talk to them. Hopefully they will tell you something you want to hear. Good luck to both you and your brother.

you could tell your father in a loving way, that you want to live with your mother,if he loves you he will understand.
