It's not. It's just another case of Bush blatantly violating the law and getting away with it because he's rigged the system.

Refusing to show up in response to a Congressional Subpoena is Contempt of Congress, a felony. See 2 USC section 190 et seq.

Bush doesn't care, because any contempt citation would be referred to the Dept of Justice for prosecution, and Bush has stacked the DoJ with people who also willingly break the law.
