they dont even use the electric chair anymore... lol :-p they use like some sort of injection thing into their blood stream i think.. and they die like that

The court determines whether the death penalty can be given. Sometimes the death penalty isn't an option, depending on the charges. Sometimes the jury is given the choice of whether to give a penalty of life in prison or death.

I will anser the second question first.
It depends on the state. I think there are only 2 ways being used in the United States, Lethal Injection and the Electic Chair. Bere in mind some states have banned it also.
In states where it is uses you have to committ a "Capital Felony". Also, each state has its own laws on that too. One that is common throughout is the murder of a Police Officer.
Some say that any murder where there is at least 3 credible witnesses.
All in all...its a state by state decision.

The method of death is usually defined by state (or federal) statute. Rarely is there any choice involved.

I don't think any state currently uses the electric chair as a method of execution, but I haven't checked all the state statutes.

you usually have to actually kill someone for the state to kill you. And i believe that the state decides on the form of death (chair, injection) if that state allows for the death penalty. (many don't anymore)
