My husband entered the US leagally about 15 yrs ago. He has a social security # and has been working on the books and paying taxes since then. Only problem is his permittion expired over 10 yrs ago...he never renewed his documentation. We have been married for nearly 8 yrs. and have a 6 yr old. We never filed any paperwork for my husband. What can we do to get him legal? Should we wait to see if an immigration bill passes? We can't afford to go to an immigration lawyer.

It is evident that many people on this site do not understand the finer points of US immigration law. Did he hold a Green Card? If so, all he has to do is apply for renewal. Failure to do so does NOT make him illegal and does not, in and of itself, make him subject to deportation. If this is the case get to uscis.gov now, download the Green Card renewal and send it off before the fees go up on July 30th.

If he came here on a non-immigrant visa, that is another matter. He is here illegally. You therefore have three choices. Hire an attorney and hope his fees don't bankrupt you or leave the USA. Alternatively, seek to regularize his position with USCIS by yourself. I do not recommend that route. You should be able to find an attorney who will give you half an hour and advise you of the chances of being able to stay in the country. From there, you can decide what you can or cannot afford to do.

There is absolutely no guarantee of an immigration bill. Even if there were, please consider the likely costs of applying. Furthermore, I doubt anything is going to happen on a bill until 2009 at the earliest.

First, learn to spell sweetie. Second, what makes him any different than the other 20 million illegals? I mean, they have anchor babies, you provided him with one.
You and he have not been worried about him being illegal until NOW? And now you are worried why? Because we citizens got the Amnesty bill defeated? And you think maybe you should just the illegal stay illegally a bit longer and hope that you get a bill passed that allows him to stay even longer?
How about as a citizen you send him back and bring him over all properly?
My parents didn't need a lawyer to bring over my dad's family from overseas. Why on earth would you need one? Can't the two of you figure out how to fill them out?
He needs to go home, he committed a felony by being here without permisson. Just because you invite me to your home, can I stay 10 years past the time I was supposed to go home? You don't mind that a bit do you?

He may apply for citizenship. Have you checked the INS website? It has a lot of good information. The forms are free and if your husband ever served in the military (you do not have to be a citizen to do so) then there are no fees for filing the paperwork. When you go to the site it can be overwhelming....take your time click on everything that pertains to your situation and read. It will advise you of what forms you need to fill out. Also, some lawyers have free consultations. If you live near a university with a law program, many of the law students have valuable information and take on pro-bono work. This may be a good source for moving in the right direction. Good Luck!

He is illegal, and you married him knowing so, AND even had a child. Not swift on your part at all. He has had ten years to correct the situation and yet, it wasn't important enough for him to do so. I believe it is to late at this point. I also would not be holding my breath as far as an amnesty bill passing for illegal alien criminals. Sorry.

Well waiting so long know no amnesty the bill didn't pass dosen't look good. I don't know since he is illegally here is your marrage valid???? Anyone know???

get an immigration lawyer ASAP.you have a good chance of remaining here when you go through the appeal process before the immigration judge.For you bigots out there,he has paid his taxes etc...thought all of them were on welfare!

he is illegal and if you go to get him legal they will say you have benn so long with out being a citizen you arent ever going to be one
