I deal with this every day from the other side of the fence from you. My company represents insurance companies on this type of situation in WI all the time. Even though insurance is not mandatory in WI being "Financially Responsible" is. As the owner of the car you have are responsible under the law no matter who was driving.

The following information applies no matter if the other car had insurance or not but hopefully you will be dealing with an insurance company because believe it not that will make this easier. You pay the money to the other person or their insurance company not to the DMV.

1. If you have insurance on the car turn it to your company.
2. If you don't have insurance and your g/f does then turn it in to her company to see if they will cover it. They most likely won't, but it doesn't cost anything to try.
3. If there is no insurance available then you have limited options.
A. Don't pay anything and lose your registration privleges.
B. If the DMV gives you the option ask for an administrative hearing. It MIGHT buy you more time to come up with the money.
C. The DMV has the forms on their website for the most common option. Which is to enter into a monthly payment plan. I would suggest you and your g/f split the cost of the payments. I would strongly suggest that you call the DMV and find out if this option is available in your case. If it is available they will require you or your g/f to sign the monthly contract. No matter who sends the checks only ONE of you should sign the contract. That is because if you default on the original contract then the other person has a CHANCE to sign a new one if the DMV allows it.

Contact the DMV right in Madison right away at 608- 266-1249 to find out what you can do. They take this very seriously and so should you.

Good Luck.

See if your insurance---if you have it--- will cover the damages under your policy for uninsured motorist.
