He will go to prison and have to sign the sex offenders register and he will not be able to work with children. After being in this country for 2 years he should be well aware of the laws governing under age sex with a minor with or without their consent. Not being a British national is not a excuse. The case can go on for sometime and he might have a custodial sentence whilst the case awaits a court date. If he is bailed he might have to surrender his passport and have to report to a police station at regular intervals. The 2nd person might get the same treatment. At the end of the day they have committed a serious crime and are in a lot of trouble and will go to prison.. Manipulating the law is not an option and can even get him a more lengthy custodial sentence. The best thing he can do is get a criminal solicitor as soon as possible.

It is when an adult has sexual contact with a minor (not intercourse), and since all sexual contact between an adult and minor is considered assault it does not matter if it is consensual or not.
