I am a U.S. citizen and my boyfriend came here legally but overstayed and is now illegal im wondering what he need (passport, birth certificate??) so that we can get married.

Depending on your states requirements, all you will need to get married is his birth certificate, and an ID of some sort; his consulate card, or his passport. This will not make the process of getting him legal any easier so don't think that it will. After you marry you need to start the process as soon as possible to try and see if you can apply for a visa, he will have to go back home. I am not sure for how long, but it can be for quite a while. My friend is a newly wed, and living without her husband while they wait on the paperwork. Good Luck.

There's a chance she can eventually get a green card through your marriage. However, she won't be able to become legal here in the US without leaving. It certainly has taken you quite a while to ask this question. Basically, you'll have to start by doing what everyone else does and that's file an I-130 IR-1 immigrant visa petition for her through USCIS. It will take them quite a while to process it, six months maybe more, then it goes to the National Visa Center and then the US embassy overseas. So, 8-12 months before she gets her initial interview. However, since your wife is here illegally, she can't adjust to immigrant status while in the US. She'll eventually have to go home at some point and do a visa interview where she wll be turned down at first, because having been here illegally for over a year, she's ineligible for any visa for 10 years. However, she can apply for a waiver through USCIS after the interview. If the waiver is granted she'll be able to return and live here legally. If not, she won't be able to come back. Sounds like your lady was given voluntary deportation, so so if her illegal stay here is her only ineligibility, she'll probably get the waiver, although there's no guarantee. Still, it's the only way you'll be able to take care of this under current law.

When you apply for a marriage license, both of you will just fill out a form asking for personal information. Just in case the clerk will require your boy friend's birth certificate and passport, it is a good idea to bring those documents with you.

Just an ID, but depending on how long your BF stayed here illegally is the main factor. Talk to an immigration lawyer before you do anything. You don't want to make a mistake that would make things worse.

You can't marry anyone who is an illegal immigrant. You would have to send him back to his home country and start the process - which can be sped up by marriage. Do it right and noboy gets deported or thrown in jail on thier wedding day.

if not your foolish for marrying him. Would ya like for him to get arrested while you are on your way to get married and deported?
