Yes. The two are separate charges in the state of Kentucky. Being under the influence of alcohol is called, duh, Alcohol Intoxication in a Public Place. Being under the influence of any other substance, excluding alcohol is Public Intoxication. Don't ask me why there are two different charges.

Yes, if the person fails the Police Officers test or Breath Test, they can be arrested for being intoxicated. It is called Public Intox. Being underage, the arresting Officer will haul the kid to the Juvenile Detention Center.

Yes. Depending on the state, this can result in at least 3 different possible offenses:

1) Possession by Ingestion- If you consent, or if police have probable cause to do a test of your bodily fluids, and they come back positive for a controlled substance (or alcohol if you are underage), you can be charged with possession of that substance by ingestion,

2) Public Intoxication: This occurs when you are high in public and your intoxication is manifested by loud, boisterous, or dangerous behavior.

3) DUI or DWI: If you are driving intoxicated. In most states, if you are under twenty-one and you show any alcohol in your system, or if you have any non-perscribed controlled substances in your system, you are guilty of "per se" DUI regardless of whether you were intoxicated by the substance while driving. (For example, if marijuana shows in your urine five days after you smoke it you are DUI by law, even though your high is long gone

If you are in a vehicle on highway & get traffic stopped ... and found to be under the influence ... you gonna get arrested ... under age or adult makes no difference.

If the police get called to some party because people are rowdy, if they find people there who are high on alcohol and they are adults, then no problem, but if there are illegal drugs there, or if alcohol is being served to minors, there will probably be a bunch of arrests

Yes they can arrest you, that is "being under the influence " public intoxication are what ever. Educational Purposes only ( I hope) lol

You can not be arrested for Marijuana if you are high. Unless you are being disorderly or you are so high that you are a danger to yourself while in a public place, then they can charge you with being under the influence, but you really have to be messed up. Its not a strong case in court. Alcohol is the same but its easier to articulate someone being drunk than high. Best thing to do is be mature. If you decide to do drugs or drink then do it in a safe place and please stay home. Only the stupid ones get caught because they decide to show their butts in public.

Public Intoxication and DWI laws don't require that the police find the alcohol or the drugs you are high on.

Yes, they Can arrest you, even if you throw the stuff out your car window, or flush it down the potty.

Yes. In CA (my city), being under the influence of pot or alcohol is 647(F)P.C. Drunk in Public. Its a misdemeanor. Child or adult, is no matter.

Yes..for public intaxication..the punishment is harsh in California...you lose your licence if you have one and can't get one untill you're 21.
