Exactly what constitutes public intoxication? How do the police know your intoxicated. Is it just physical signs like weaving while you walk? What if you don't weave while you walk, or some other obvious sign? Do the police really give you tickets and/or arrest you for public intoxication? And, most importantly, what if you're just waiting for someone to pick you up so you don't drive drunk? Can/Will they still ticket/arrest you?

The standard for public intoxication in the state of Kentucky is 'manifestly under the influence as to be a danger to themselves or others or to cause annoyance to the general public'. If you meet those standards, the officer can and probably will arrest you. Personally, I would rather be safe than sorry. If I just cite you or do nothing and you end up getting hurt or killed, it becomes my fault. I'd rather arrest you than have you getting hurt or killed on my conscience.

Public intoxication normally has the same standard for DUI (usually .08%). If you show no signs of the intoxication, then there is usually no reason to stop you. However, at that blood alcohol level, chances are you are doing something to indicate that you are not sober. Many towns will ticket you for that. Most of the police in cities are too busy elsewhere, unless there is an order to clean up an area. The penalty for public intoxication can be severe if you are a minor. A minor who is found guilty of public intoxication in New Jersey may lose his/her driver's license until age 21. If you have not gotten your license, you can be prevented from even applying for one until age 21.

Usually the only time people are arrested for a public intoxication charge is when they are causing some other kind of disturbance.

If they deem you are under the influence of alcohol or drugs to the extent of being a danger to yourself or others, then yes...you can be arrested for Public Intoxication.
