Ok... so like why is it ok for minors to have a blood alcohol level of .02 while driving.... if they have that and they get pulled over do they get arrested for being under the influence? I know .02 is like almost nothing but i was wondering what would happen if a cop pulled them over while they had a .02....

if a cop pulled them over with only enough alcohol to make them have a .02 blood level is that ok too??? hehe...

the .02 is because some mouthwashes and other things contain alcohol which can give you a hot read.

The state of Kentucky says that .02 if you're under the age of twenty-one is a DUI. The offense isn't enhanceable, meaning it doesn't count towards more serious penalties if you get more than one, like you would if your BAC were over .08. If you blew a .02 you would be taken into custody (to jail if you were over eighteen) and charged with Under 21 DUI. If you were caught in a vehicle with alcohol and you were under the age of twenty-one, you'd be charged with Possession of Alcohol by a Minor.

In Texas, it is DRIVING UNDER THE INFLUENCE OF ALCOHOL BY MINOR. (a) A minor commits an offense if the minor operates a motor vehicle in a public place while having any detectable amount of alcohol in the minor's system.
(b) Except as provided by Subsection (c), an offense under this section is a Class C misdemeanor.

In Missouri it is not considered a DWI/DUI. It is considered an "Alcohol Administrative Suspension". You license is suspended. It is not a criminal charge.

But we have a local municpal ordinance that states: "minors are charged with minor in possession of alcohol by consumption".

For a minor, having a BAC that registers at all is illegal. Driving is not required.
