A lot of juveniles claim that this or that behavior is not really sex so it doesn't count. Well fully clothed hugging, kissing is probably allowed.
If there is intercourse or oral sex, or reasonable suspicion that it occurred, even if it did not, and one of the parners is below the age of consent where it happened, then the other partner can get charged with statutory rape. Proving the charge is another matter. If convicted in USA, after getting out of jail, the felon must register as a sex offender for the rest of life.

Depends on the state where this occurred more than anything else. If the age of consent is 16, then they could have full on sex in a room full of adult witnesses and be ok.
