It was Jesus. A woman was caught in the act of adultery. The Old Testament had a law which said she should be stoned to death. It was a law which was never enforced but a crowd gathered around her threatening to stone her in order to trap Jesus into either letting her be killed, or telling them to disobey the Old Testament. Either way he would have been discredited. In an act of brilliance he didn't give either of the two possible answers they expected. Instead, he said, "He who is without sin cast the first stone." They all knew they had sinned so they dropped their stones and walked away. Then he told her he wouldn't judge her either, but to go and not sin any more.

The term comes from the New Testament (John 8:7), where Jesus defends an adulteress against those who would stone her, saying "He that is without sin among you, let him first cast a stone at her".

In the bible a group of menwere going to stone a woman for being unfaithful toher husband, Jesus used the phrase. The woman was not stoned to death. Don't talk about how bad others are when you have sins enough of your own.

"Let he who is without sin cast the first stone".........is what I remember from the bible, it was probably JESUS. It means if you are totally without sin, then you can cast the first stone.
But usually we are all somewhat sinful to varying degrees and so we cannot cast the first stone, or demand punishment.
