You won't become responsible for money he owed before you got married, but if you file a joint return, you are equally responsible for anything owed for that return.

If you file a joint federal return and have a refund coming, you would have to file an injured spouse form to get the portion of the refund that is due to your earnings, since they'll take his share of the refund for his back taxes.

Do you mean just that you live in IL, or that it's IL state taxes that he owes?

Most states are "common property" states - that is, without a prenuptial agreement, you and he exchange debt and assets at the time the vows are said. If he comes in 50,000 in debt, half that debt becomes yours.

Best to talk to a lawyer if you are not keen on getting his half of the debt, but want to marry him anyway!
