H1 visa isn't a immigrant visa, it's a non-immigrant visa, consequently, illegal immigrant won't gain any status.

Currently you cannot be converted to any kind of legal status from illegal with the exception of asylum.
They would still be illegal although they could do the voluntary leaving with an application to come legally.
If caught they can still be deported and an involuntary deportation would make them inelligible currently to come back for 10 years.

Even if he marries a US citizen, he is still an illegal alien. Even if he has a kid here that is a citizen, he is still an illegal alien.
