both kids were evaluated by a place to see if it did happen and as far as it is known now it is that the three year olds word is the only thing they have to go on. What do you think I should do next?

Find out what the truth is first and then proceed with whatever action it is, that is deemed necessary.

Addition: You haven't mentioned how old your son is. Since the other child involved is only three years old, I'd be inclined to believe that child.

I can't see how a child of that age could make something like this up, unless it actually happened.

Did your son do what he was accused of
Depends if nothing happened and it was made public, yes you could sue for damages to his character.
But by suing you could bring accusations out to public scrutiny which could cause your son more embarrassment if he didn`t do it

can you prove that it didnt happen ?
kids tend to touch out of curiosity so just laugh it off and make a mockery of their accusations !
