you cant get a penny of support from him (unless he pays you voluntarily) until you have a court order. once you get taht he will more than likely be ordered to pay back support from the time of birth......and the military will make sure he pays that. you have to file with your local family court or child support office first though.

you MUST establish paternity first...................go to your local child support office and begin a case they will then do the requesting for you........once the DNA comes back as him being the father you will both submit papers stating how much each of you makes etc...............when you do this as he is in the military you MUST ensure that he places the child on his page twos and at that point your child would be covered with FREE medical [no co pay etc] not you just the child.........

Once the child support order is in place and he for any reason does NOT pay then you involve the military..they DO take a very dim view of non payment BUT if you call before there is any court papers settled you are basically just some other female trying to get money out of some guy...........and of course they are not going to MAKE him pay a damm thing at that point are they.

is he on the Birth certificate........do you have any pictures of the two of you together and what sort of relationship history is there between you two, has he ever seen or acknowledge the child........I ask as these are ALL questions that I had to prove before California would even start my case.

Just like everyone else. His name has to be ON the childs birth certificate. If it's not you will need to go to court to get a court ordered DNA test. If that showd he is the father than you get to go to court again. Once that is done if you don't have it already you will need a court ordered motion for child support. Once you get that you can serve that to the military and have his pay alloted for the child support. If you don't have any of the things mentioned you have a long trek ahead of you. Just because he is in the military does not mean that you still don't need the court involved at every level just like they would need to be if the father was a civilian.

Be careful what you do. If you start calling commanders and first sergeants to complain about child support then all you will accomplish is hurting his military career (and possibly) getting him kicked out. And that's not going to do anything to assist you in getting child support. If he gets demoted or discharged then he's not going to have much, if any, income to pay child support out of and if he's no longer military his dependent isn't going to have any dependent benefits either. So, think about it.

you need to contact his commanding officer and let this person know that you are not collecting child support . He or she will probably be able to send you in the right area . if he does not then contact the jag officer and let their office know and also let them know if the commanding officer is refusing to help you . the government does not take kindly to their personell not paying child support and they will take care of the problem . good luck and email me if I can be of any further assistance .

first, establish paternity. then get a court order. once you have that, you can contact him directly and give him the opportunity to set up an allotment voluntarily. if he refuses, then you contact his Command, who will enforce the court order.

But without a court order, you can do nothing.

Send him a letter explaining the need and request it from him.
