Aren't we being inconsistent? There are places in the U.S. where she could have had an abortion last week and it would have been legal.

He is believed to be the father, so in that case Chloe IS his baby. Parents have the right to kill their unborn children, correct? Isn't that why abortion and disposing of frozen embryos is legal? So what's the problem? Do we really want to be in the business of forcing people into parenthood against their will? Clearly, this baby was unwanted. Isn't it better that her life was ended before birth rather than her growing up abused and neglected? Besides, there are too many people in this world anyway. (Did I miss anything?)

To answer some of the other "answers"

A woman is on her way to have an abortion. While on the road, she is hit, broadside, by a drunk driver, killing the baby and the woman.

The drunk driver is charged with two counts of murder. . . why? Wasn't she on her way to kill her own baby?

If we, as a society, are going to call an unborn baby a human in one instance, why not in every instance?

Privately opposed to what, exactly?

I think pretty well everyone agrees that a person who commits murder should be charged with murder.

If you are asking if the death of the fetus should be termed murder, I think that most (not all, but most) people agree that by that far into the pregnancy, personhood is clearly established. There is a vast difference between a first-trimester fetus and a third-trimester fetus. I personally think that elective abortions should be restricted to the first trimester (excepting for cases of the woman's health, of course).

Murdering a pregnant woman is illegal. In fact, murdering anyone is illegal no matter what state they are in. What exactly do we have to be privately opposed to?

The apparent delima is all man made. It should never be legal to kill a baby even if it hasn't been born yet.

No no one would. Nice try to make the connection from murder of the mother and baby to abortion of the baby, but it just didn't quite land right.
