can you go to jail if you are married but lied when you jonied the army saying you are not married?? what can happen if they found out..my friend needs serious help!! Sh'es been in for 1 year.. There's a special investigator that is meeting with her tomorrow..told her for an hour and needs her to bring id.

Jail ~ not likely. I have seen this happen. Likely a repremand (slap on wrist) or at worse an Artilce 15. Depends on the situation really. If it was a motivation of money or adultry it can be more severe. Not sure why she would do that, tenatively you make more $ being married.

Trust me, Article 32 will not stick, that is a typical JAG slang. They would have to prove a motivation to get article 32 to stick.

Wayne (post below mine)... perhaps you aren't getting the point.. the army has changed since the 1970's, and I hardly think a SSG could make that determination in the first place. This is a time of war, even GO1A violations aren't that harsh. Stop pointing to useless facts.

I too am totally confused as to why she would lie about not being married, anyways just to reitterate on what everyone else said, I highly doubt she'd get jail time, maybe an article 15, a discharge at the most, but I doubt that would even happen. Hey, they could be meeting with her something completly unrelated, alot of sh*t happens in the army, I wouldn't worry about it, atleast I would try not to worry about it.

This is NOT civilian law. The UCMJ is a very cruel task master. She can be brought up on charges for court martial for her husband committing Adultery.

I was a guard at a Court Martial in May 76. The guy had been smoking hash before reporting to our shop each morning. Our NCOIC followed him took him in custody and brought to the the Lt as the CO was out flying. The Lt. told him to empty his pockets, he did. They all stood there looking at the hunk of hash. Walter picked it up and ate it. The Court Martial took 10 minutes. The only witness was his section leader. The only question was "What does this man do" A. "He repairs airborne navigation equipt" Judge. "Thank you. You are dismissed". 3 minutes later the armed guard was called in. he came out with Walter in cuffs. I was told to get a Van from the Motor Pool. We (myself and our NCOIC) took Walter that night to Coleman Stockade to serve 120 days with a suspended BCD. That means he gets a General if he behaves. I went back there 3 weeks later to take some issue item to him. The guy in the bunk to his left was in for rape. Another guy had murdered a German Civilain on a US Base.
Walter had "Disobeyed a direct order". Eating the hash changed it from an Art 15 to prison.

I believe Jim and the Rock. i replaced right into a protection tension MP and that i'm at present a civilian cop. military detention center is greater puzzling than maximum civilian jails. No rank, information all day, march around everywhere you flow. Attitudes and screwing around are no longer tolerated. you will no longer discover adult males enjoying ping pong and looking out at soaps in a protection tension detention center thats for dam confident.

She could be jailed under Article 32 of the UCMJ (Uniform Code of Military Justice) or a specifically-levied charge of perjury, but more than likely she will be discharged on that basis and sent back home. Tell her to request counsel from a JAG attorney so that she can be protected to the extent it's possible.

Don't know exactly why she would lie and say she was not married b/c you get paid a lot more being married than a single person. Also the spouse wouldn't be on the insurance. At present it is 400K.

why would she lie about being married if she had all the paper work stating she was then she has nothing to worry about .but if she lied to get more money yes she can be fined and even discharge from the army

If she was married when she went in, and lied about it, she is not too bright.
1. She will get paid more if she is married (housing allowance)
2. It is illegal (fraudulent enlistment)
3. It just might piss her hubby off to know that she wants to hide him from the world.

She shouldn't get in trouble for it unless she was being questioned during a formal investigation and lied about it which I have no idea why one would do that.

i dont think she'll go to jail for that. probably she'll get a discipline penalty. the worst scenario is that she loses her job, but it's all about army laws, which i dont know exactly.
