In the eyes of the Catholic church if you are Catholic & marry outside the faith then you are commiting adultery. If you are not Catholic but are Christian & you get married in your denomination then your "safe" to them.

Tha Catholic Church recognises all marriages in any legal form from any religion or otherwise. Catholics, however, should be married in a Catholic church or they could be considered to be living in sin. Sin, however, is a matter between a person and his/her god and it is not something that another can rule or comment on.

It all depends...
We're talking about mortal sin. When it comes to mortal sin the Catholic Church teaches:
(Catechism) 1857 For a sin to be mortal, three conditions must together be met: "Mortal sin is sin whose object is grave matter and which is also committed with full knowledge and deliberate consent."
Hypothetically, a couple is "married" via civil union. Sometime in the future, they come to the realization that they are not married under the eyes of God (that is - living in sin) at least or until they receive the Sacrament of Holy Matrimony.
In spite of this knowledge, they choose to remain unmarried. If this choice entails the three conditions that warrant mortal sin; 1) grave matter, 2) full knowledge, and 3) deliberate consent, they are indeed flirting with "go to hell" material.
Of course, because of our inability to read other peoples' hearts, it's not for us to determine who's going to hell and who is going to be saved. That's God's call.
We can easily descern what sorts of behavior constitutes mortal sin, but we should always remain hopeful that there is something about the people committing these sins that will provide for them the possibility of salvation, in spite of their sin.

No, this is bunk. A city hall marriage is legal, whether or not the Catholic Church agrees. It's not living in sin, because it's a legal marriage.

if you are catholic and not married by the church but rather by a J.O.P, the marriage is not recognized as a Sacramental union and yes, you are living in sin. going to hell.... that's your choice - of you accept Jesus as your Lord & Saviour.... well that's entirely up to you.
your children can be baptised, make their communion an dother sacraments, however until your marriage is blessed in the church (again, if you are Catholic) you can not fully partake of the Eucharist.

My church will not perform a spiritual marriage without the proof that the couple have already been married by the state. :)
