Firstly you need to find out why she won`t assist in the matter if it was sexual assault. it could be out of fear or embarrassment. You need to talk it over with her and solve these issues first. If she still won`t help then you may be able to put a case against the person that did the assault as something like endangering your daugthers way of life or causing mental anguish or a civil case

It might be hard to prove the assault if she is unwilling to assist. The courts can subpoena your daughter and get evidence from her with a warrant. But that doesn't mean that she won't lie if she has to testify against him/her.

Is that family member an adult, if so you can have them prosecuted. if they were both under seventeen if it was not consensual then you can still have them prosecuted.
