It might be hard to prove the assault if she is unwilling to assist. The courts can subpoena your daughter and get evidence from her with a warrant. But that doesn't mean that she won't lie if she has to testify against him/her.

Is that family member an adult, if so you can have them prosecuted. if they were both under seventeen if it was not consensual then you can still have them prosecuted.
