I was sitting at a red light when an ambulance can form behind the guy to the left of me pulled forward diagonally in front of me. After the ambulance went throught and the light turned green the guy pulled into the lane that I was in and drove at around 15-20 mph in a 45. He then slowed even more as if he were going to pull into a gas station, when he didn't turn I got right on his butt and he flipped me off. I got into the left lane and passed him and returned to the right lane. I got about 50 foot on him and hit the brakes while flipping him back off. The road was wet in this spot because of a banks sprinklers, and the wheels locked up for a split second. He didn't even have to hit the brakes because I had enough room. At this point he started to point to the side of the road like he wanted me to pull over, but I continued and he followed for two miles. he then got next to me at an intersection and said that I could expect a ticket in the mail for careless driving.

He did get on the phone when he was following me and he did stat my address when he pulled next to me. But, he never showed me his badge , told me his name, badge number or department. He never asked for my license and registation, name , or if the car was registered to me.

Yes an off-duty officer can write a ticket, however, that is not the norm.

Any officer NOT in uniform should have been able to produce a badge and ID card as well.

From the sounds of it....this individual may not have even been an officer and just made the comment about "expecting a ticket" to make you THINK he was.

Your senario indicates a bit of wrong on BOTH sides with some pretty aggressive driving and heated tempers.

A bit of anger management sure seems to be needed by both!

If he hasn't pulled you over, and he didn't run your name he can't entirely prove who was doing the ''poor driving". This simply sounds like a road rage incident. Even though PO's are always on duty, so to speak, there are jurisdiction issues and then it comes down to who is actually operating the vehicle. If your driving someone else's car and not your own, it would be very hard to prove. Reporting road rage is big in my state. I have used it many times for justifiable reasons but a person can be vindictive or just be in a pissy mood and report someone for something that isn't really a true complaint...just a mere annoyance. Anger management is a good suggest as stated above. I would say next time just pull over somewhere public and let them pass, or call the police.

I don't think I would worry to much about that. If, by chance, you get a ticket, go to court and fight it. It sounds like you would win on this one. It is just your word against his and from what you said he did more things wrong then you but you need to control your temper because next time someone pulls up next to you after you have just flipped him off you may get bullets instead of a ticket coming your way.

Yes, In escence a cop is never off duty. I don't think you will get that ticket as you never signed it so I can't see how he could ever prove you were driving the car. Good Luck.

Let it go to court and protest it on those grounds. He is legal to give you a ticket and you should have been under control of your car at all times but he gave you no warning and if he shows up in court at all, you might still be able to win. If he doesn't show up, you might win under those conditions or they will postpone it for another day.

He can issue.
Will he? I doubt it, unless he wants an internal invest on 'why' he would flip you the bird and play the brake tapping game while driving. He can be in more trouble than you for his actions.

In most states officers can always arrest,issue tickets,and carry a gun.

Heck, off duty cops can even drive their assigned cruiser, on free gas at the expense of tax payers!

you pissed him off he probably not a cop anyway.he may have reported you,but i dint think they can just take someones word for that.i wouldn't worry to much.
