You have to go about it legally. You have to prove that you are not trying to default anybody that might be owed. Then you have to fill out and file paperwork. Then you have to run it in the newspaper for 4 - 6 weeks. Then you go before the judge with proof that you ran the name in the paper to see if he would authorize it. Then when he does, you take the court ordered paperwork to all the places you need to change the name. Depending on what state you live in, the applications could be found on the states website. Or you can get a lawyer to do it all for you.

Your son can go through the court system to change his name. Call your local county clerks office and ask the specifics on what is needed to be done. Usually they will have you fill out some forms, put an ad in the paper saying you have requested a name change and who to contact if someone wants to challenge it or object to it. If no one objects within the time limit the judge will grant the name change.

My nephew took his mother and step-father's last name when he turned 18. He did not get a lawyer. He filed the papers himself with the court and went in for a name change. It was fairly easy to do.

go to an attorney, explain your wants and why, they will type up the paper work, serve 'dad'. if he cant be found then you will have to provide 'dads' last known address and pay for an ad in the newspaper for 30 days, show up in cout and the judge says you do not have that last name any more, probally you will take 'moms last name if remarried or her maiden name

In some states all you need to do is file it with the court. You may not need a lawyer for this. I would check with your local county courthouse for whichever division handles birth certificates. They will be able to direct you to the court that you need to see. Good luck.

YOU CAN GO DOWN AND GET THE PAPERS FROM A PRINTING CO OR GET A LAWYER AND DROP HIS DAD'S LAST NAME THEN YOU GO TO COURT AND GO FRONT OF THE JUDGE AND HE WILL DROP IT
