I know a few cops and did you know if a cop finds a beer cap in your car it can be consider "open liquor" cops will usually only do this to nitpick with somebody who is giving them a hard time. This really isn't a question it's more of a did you know this.....

A beer cap is not considered open alcohol. You must have a container, preferably the original, and enough liquid to take a sample of for analysis.

A defense attorney would love this. Get that officer on the stand & let him explain just how much alcoholic beverage that cap contained.
I believe the code sections state alcoholic beverage container AND they have to actually contain an alcoholic beverage.
Now what it could do is give probable cause to search the vehicle for the container the cap belongs to. As someone already said, it makes sense that if you have a cap, the bottle is likely to be there also.
Really, REALLY weak charge if some cop is actually citing based on just a cap.

It really depends on the state your in and is connected with the idea that if a beer cap is in your vehicle you must have had an open beer container in your vehicle which produced the cap. As you said, it's typically used as a means to justify further questioning or a search of your vehicle.

Well, it kind of makes sense. Why would there be a beer cap in the car, if there hadn't been an open beer bottle in the car at one time or another?
