I got in a car accident today. No ticket was issued, but the officer said it looks like it was my fault although there were no witnesses except the other drivers friend who of course insists it wasn't her fault....I fully know it was. So, if he issued no ticket, does that mean neither party will get one?

Thanks guys. The officer told me to call tomorrow to get all the info about the insurance, where my car is (already know where it was towed), and get the report to send to my insurance company. So, that's still no indication of a ticket? I know 100% I was not at fault (my car is totaled) but I don't feel like debating it and fighting it in court. At least this is one less stress I have to worry about...thank God for full coverage insurance.

Thank you all once again. I didn't get a ticket, but got he blame for insurance purposes. Thank God I was alone and only hae minor injuries....can't say the same for my van. My whole drivers side door is in my seat...the paramedic that took the glass out of my head said I'm lucky to only have the few injuries I got. Somebody was definitely looking out for me. Thanks again, and drive safely (the seatbelt really saved my life).

If there were no independent witnesses to this accident and all parties claim the other driver was at fault then no ticket involving fault would generally be issued unless there was some clear evidence to show the officer the guilty driver. A good example would be a rear end collision where almost 99 percent of the time it would be the car furthest back so the officer can cite without a witness. If the drivers friend was a passenger in the involved car than he/she can not be used as a credible witness. There is an easy way to find out if you want to be sure. Simply obtain a copy of the accident report from the agency that handled the crash and it has an area for fault and if a citation was issued .. Hope no one was hurt and all my best!

California works this way (I don't know what state you are in), only officers who have attended specific training in accident investigation can issue a citation for an infraction at an accident scene. Otherwise, the officer would have had to observe the violation.

As said above, usually with no independent witnesses, nothing further occurs. In the event there are independent witnesses or other compelling physical evidence, the officer would send the completed report to the traffic court with a complaint request. A complaint request basically means they are requesting the report be reviewed and the charges listed in the report be filed against the offending party.

So, in short, a ticket not issued at the scene of a collision does not mean you will not be held to answer at a later date.

After investigation, when they figure out who was at fault, you may get a ticket.

yep, you won't get a tcket if he didn't issue you one at the accident...your only concern at this point is convincing both insurance companies that the accident was the other guy's fault!

usually a cop tickets you at the scene if he's going to
