is this how it works like a death of a driver say there rivals on the track and one of the drivers take one of each other out and the one of the drivers were to die would that driver that caused his or her death most likely go to jail or be free an

ok Dale Sr is dead and all who wanna put blame or throw someone in jail for killing him during a NASCAR race where all teams and drivers sign a waiver stating noone is held responsible in case of tragic accidents NO!!!!!!!!
as for Dale SRs death there were several factors to his death.
before race Dale SR stated that Micheal Waltrip will win the race.

next when was the last time you seen SR hold or block for some other driver to win race.

another thing was the neck brace which he wasnt wearing.

and the big one SR and his team had cutt his seatbelt 2 inches like they always have done. theyve done this due to the belt cutting into his side.thats where the seatbelt rule come from which Ray Everham got busted for when he was still with JG

time to move on thats the past and nothing will change that but heck a lot more talented drivers came out of it

No but I believe it should be taken into consideration how a driver was driving at the time. If he was recklessly endangering everyone else and killed someone then it should be considered. Also if he was found with drugs in his system then that could be another thing. Dale Earnhardt Sr's wreck didn't look like something that would have killed him but it did. That is why you see that it is so easy to kill somebody driving like a fool at high speeds. Those races should be raced with caution. A bump and run, fine. Drafting in the straights, fine. Sending someone to the wall for the heck of it, not fine, especially at high speed tracks. Those corners aren't the place to play. There are different circumstances for each track. It would be hard to prove that someone intentionally tried to kill someone. Reckless endangerment yes.

Don't think so.
If a driver were to die due to and on track incident,this would be investigated but more than likely be a racing incident.
As for the "death penalty" this would be when a team is suspended for violating the rules(not just one or two members but the full team including the car.)

not really.. then again it depends on the circumstances and state it happens in. if Kurt Busch had hit and killed Tony Stewart's jackman Jason Lee, at the race a few weeks back, then he would definately be banned for life from NASCAR at the very least, plus he would've been arrested for manslaughter, again at the very least. Racing accidents (i.e. Dale Earnhardt's death) are just that, accidents. Racing "accidents", drivers aren't liable for. Every driver has to sign waivers and such before they can even attempt to qualify for races.

The drivers are well aware that they can die in a race. And even if one driver really wanted to kill another, no one would be stupid enough to commit murder with that many witnesses.

And this isn't limited to racing either. It's not unheard of for a boxer to die in a fight.

Look, if there is a crash on the track and someone is killed, thats a racing accident. No one is going to be charged with murder or anything of that kind. Although the tapes and other witness testimony may say that a driver took someone out on purpose. no murder there.

Its like saying if someone kills someone in a boxing match will they go to jail. Of course not the drivers are putting themselfs at risk

No its not.
Racing is dangerous sport its not a matter of if u spin the guy its if he hits the wall at like 200 like Dale.
Also wut happened to Dale Sr. was because he didnt wear the neck restraint he should thus putting himself in grave danger.
The sport of racing isnt 1 guy after another most of the time when to people hit eachother its because one is loose or tight.

No that is not how it works. If something like that would happen it would be considered an accident and part of racing.
