say a woman is dating someone then has a child with them and the child takes the last name of the father. now if the mother and the father break up and the mother takes the child and she gets married to another man. so which last name does the child take?

if the new man she marries already has a kid with her before the child with the initial man, does that change anything?

The child keeps his birth name UNLESS he is adopted legally by the husband.

The child's name stays the same unless the person she marries adopts the child. If the biological father signed the birth certificate the mother will have to get him to sign a paper allowing the adoption of the child. In some cases this is easy and some cases it is hard but some do not like paying child support if they do not see the children and will sign them away.

If he signed the birth certificate then the child has his last name. But if you did it under your last name then the child has your name. And when you or whoever gets married you dont need to change the name if you dont want to. You can always keep it what it is! I know a lot of people who have gotten married and kept there child's last name not the guys!! Good luck hope this helps Megan

I was a child in that situation, I was not legally allowed to use my new fathers last name until he adopted me, which took 5 years as my biological dad fought. Also because he did not pay his child support by the time the judge deemed adequate to get caught up, my adoption was finally granted.

Only if the mother chose to name it after the father before marriage then it would stay his name . If she chose not to give his name , then no it would go under her name . If she remarries or has not been married before the child would still kep her name but not her married name from the new husband .Unless he chose to adopt it .
