My son is 6 years old and his father and i have been seperated since he was 2 months old. He currently lives with me and sees his father every second weekend. We have no court documents its just an agreement between myself and his father. I have been offered a job interstate that I would really love to take, but i am unsure if legally i can take my son with me and what i need to do to make it all happen. Id be happy to fly my son to see his father for school holidays, i still want him to be apart of his life but i also want to be able to move on with my life too. Any advice would be greatly appreciated.

If you have never been married to this man then legally you can go where you want with your child, if you were married and got a divorce and you move off it can be considered kidnapping...so it just depends, you could call a lawyer who could give you free advice , he will be able to answer any questions.

Theres NO Legal document from any court-procedure so you gotta talk to your ex and make sure he will still be able contact and visits.Maybe if he doesnt want you to move he can start court-procedures soon and then you might not be allowed to leave state so talk with him before accepting that job,isnt there any similar carreer-move closer to home???I think personally you should leave things behind and start living a new life..finding a new partner etc.Talk honestly with your kid aswell,what does he want....he is a big boy of 6 afterall and realizes MUCH more than you probably think

You Must see a lawyer. The problem is that you never said you had been married. If you were, you could be charged with kidnapping should you leave the state. You probably to make a motion in court to allow you to leave. expect a 6-10 grand cost with of a fight.,

You need a lawyer, and a written agreement before you can take the child out of state.

forget legally, how about whats best for your child he needs both parents, you should not move out of state
explain to your boss he/she will understand, you might make brownie points and maybe a better job where you are at.
other option, talk with your x, if he can relocate to where you are going then go for it.

Well, it can't be illegal if nothing has been done through the courts.

As long as you have an agreement to it, it shoudl be fine. but i would consult with an attorney to be sure
