You need to get a grip on reality and stop lying to yourself. There is more to this than what you are saying. In not state in this country are you going to go to jail for Mere verbal threats. There has to be an overt act. So, he obviously took action and that's why he is in the joint... and you know it.

Talk to the police(preferably the arresting officers) first, explain the situation. Talk to his attorney, because the truth will come out eventually. Is it a felony? If he is truly innocent, take the case to trial b/c it's his right to have a jury trial. Testify, just keep telling the truth and a jury will believe it. The courts don't move very fast though, so it will be difficult to get anything changed soon. If he keeps fighting the case, he may not even go on trial until later this year, like Oct. or Nov. If you are not telling the whole truth in the first place, you aren't going to get anywhere with the courts. If you testify and don't tell the truth, thats perjury which is a felony.

All you can do is wait this out. If there is no case then there can be no charges filed. The D.A. will have to prove his case and if they can't he should be released. But, if they are keeping him from you it is for a reason. All you can do is explain what a help he is to you in your time of need. My boyfriend went to get donuts last Wen. and just didn't come home. We have a 7 month old baby and he watched him while I worked. It is very difficult because we need him. He was taken in on an assault charge that the police don't even have on file. All I can do is wait for a court date so that we can prove this and he can come home. So needless to say I am going to bed alone at night. I can't talk to him or call him or even visit him and it's killing me. I hate that this is happening and all you can do is learn from this. Good Luck and I am truly sorry this is happening to you.

Basically this case is going to boil down to her word against your and your bf's word. If there were any other people in the near vicinity that may have seen or heard what happened and can help you. You can also petition the judge who is to hear the case and ask to meet with him regarding the case. Call his appointed lawyer and ask him if you can petition the courts to drop the charges against you, at the very least, as it never happened. That is really about your only choices at this point. Call attorney and petition judge. Good luck to you all, I certainly hope this woman gets over her vendetta against you all and gets on with her life!

Well you are going to have to wait until that court date when the bail is set. In my town, court happens once every 2 weeks, and in the town next to mine, once a month. Find out the next court date, and start saving up money. Once you post the bail, he will have to attend court. If he "jumps bail" you lose all of that money. Make sure you go and visit him, talk to him about what he is facing and possibly contact a lawyer for him. GOOD LUCK! :)

In my state to get the no contact order lifted you must attend a S.A.F.E. class. This class is to teach you about domestic violence. He must also start his program. The judge must believe that he is no longer a threat to you.

Sounds like you left a lot of details out. Its her word against yours AND his...so why else would the police arrest him other than the fact that they thought you and he were lying?
