Yes, its called conspiracy to commit murder, and if the crime does occur, the murder itself. Its kind of hard to deny premeditation on a contract hit.

I don't think asking it in a theoretical/hypothetical sense is illegal. If you ask it with the actual intent of hiring someone, then that's illegal.
