I was physically abused by my husband. I called the police officer and they told him to leave for to night. I did not know that when my husband comes back he is suppose to be excorted

Your husband left for the night, but he still legally lives there. The Police are not an escort service. It's time you decide what direction your marriage is going.

It depends on whate state you are in.

Here, If you are physically abused by your husband you would be entitled to seek a restraining order. If the order was granted you would have a temporary order barring your husband from returning to your residence and having any kind of physical or verbal contact with you. A judge may grant your husband a time frame of approx 10-15 minutes to gather personal belongings and he would have to be escorted by an officer. After that if he returned or contacted you he would be in violation of the order and his arrest would be mandatory for violating it. If you had visible injuries or if you complained of pain due to the physical abuse his arrest would be mandatory on your statement of pain or visible injuries that you display to the police. After an approximate 10 day period you and your husband would have to go to family court where you would either drop the order or have it made permanant.

Are you asking if he's supposed to be escorted?

I would assume if he was, that he would only be able to pick up any belongings of his, or so the two of you can talk, without things getting violent again.

Kim is correct, in cases like this especially if it leads to you filing for divorce an officer is required to escort him as well as provide protective supervision if you ask for it.
