Ok, lets a person is driving their partner's car and meaning they live together and are not married, and they are driving home drunk, hits a park car goes over the roof and lands on the roof of the car they are driving so basically both cars look like crap no longer able to drive, the person that is driving drunk is a good driver never in trouble with the law,but they aren't coverd under their partner's insurance, is their partner's insurance company stil going to pay for all the damages to both cars even through there was a DWI and the person driving was 3 times over the legal drinking limit? If not what happends, do you go to jail and have to pay back all the fees? Are you safe for jail but have a certain amout of time to back back everything, it probably is going to be thousands of dollars worth of damages so the court should give some time to pay everything back right? Last question how long does that person loose their license for?

Chances are high that the insurance company will deny the claim, because you live together. If you didn't live together, your friend's insurance may have covered, but when you reside in the same house, you must be listed as a part time driver, or an exclusion must be placed on the policy. You will probably be sued by the other driver, their passengers, and possibly, their insurance company. Your license will be suspended, you will have to carry SR22 insurance for three years(most likely)and the alcohol offense will be on your license for ten years, causing your insurance rates to be higher, and with each additional alcohol related offense, the rates rise and you risk being cancelled. Depending on if it's your first offense, or more, will determine if you get jail time, home monitoring, a combination of jail/work, and what your fines/fees/court costs/lawyer fees/alcohol rehab classes/reinstatement fees for driver license will be. You can lose your license for 30days or longer, again, depending on your prior record.

Lots of unknowns here like what kind of policy is on the car ie full comprehensive. Since the person wasn't on the policy, more likely the insurance company will try to pull every string trying to get out of paying for it. The person will more likely take you a claims court to try and get money from you, if you refuse to pay up willing for the damages. As far as license suspension goes it depends on which state. A call to the local DMV will tell you this.

Man, that is a serious run-on sentence.

It is mostly up to the insurance company, and your local laws.

They will generally give you time to pay stuff back - but if you don't, they will take it out of your paycheck.

How long you lose your license for is up to the judge - though I would hope they would put you on a bicycle permanently based on your story.

First..........the drunk driver will definitely get his/her license suspended or revoked. Most likely the insurance company will pay for the damages, but the car owner's premium rate will surely go up.
