You can try but most likely the owner of the check probably already cancelled/blocked that check and if he did not, when it gets cashed and if he/she notices it, will put an investigation with the bank. And if you presented your ID to cash it and or used you account to cash it, they have you.
Do the right thing and dont do it.

If it was a mistake and you cash it, you will get money now, and pay it back later. That is against the law anyway why do it?

If it was truly a mistake, and not due you, it really could become a legal matter, depends on the amount.
A large amount, a bigger fine, and more trouble for you.
Really, it's not worth it. Just be honest and let who ever made the error know.
It could cost them their job.

You very likely could cash the check but it would be fraud if you knew that these funds were not intended for you. That would subject you to prosecution.
