I mean im confused because it says it is, but then if you download movies, cds etc. thats illegal.

So what is it? a loophole or what?

My understanding is that it is 50% legal and 50% illegal...lol All shareware programs are compeletly legal as long as your just downloading, if your uploading, then you run into it being illegal. I download from a couple sites similar to that, but i make sure to shut off the feature that allows people to upload from me.

The way file sharing programs work, is that usually things like torrent programs are entirely legal. BitTorrent isn't going to get shut down because bittorrent is entirely legal, It's the torrents themselves that're illegal. The same applies to Ares Galaxy, ares itself is entirely legal, but if you start downloading Pirates of the Carribean or something, that's illegal. The way it works is basically a loophole, other people (illegally) host things, and ares simply finds them for you and lets you download them, so the program's not illegal. You can just download legal stuff if you want, but if you download cracked video games and movies, you may not be so lucky.

All P2P programs are legal, but it's what people do with it that makes it illegal.

If you're using a P2P program to download a Power Point presentation from a co-worker because your business e-mail address doesn't allow files over a certain size, then it's legal. But if you're putting copyright music, movies, etc. for others to download, then it's illegal.

For now, P2P program may be legal, but in the future, it might not be so legal anymore because of the abuse. Movie studios, recording studios, game developers, etc. do have a good point in saying that P2P programs contribute to piracy, so P2P program may be considered illegal if it every goes to court.

It must be legal otherwise the authorities would have closed it down by now.

The loophole is that you can share a file as long as you do not attempt to sell it or try to make money out of it.

The program itself is not illegal since it has legal uses, such as distributing large files you've made. However if you use it to download copyrighted material (TV shows, music, games...) then what you're doing with the program is illegal because you're breaking US/EU etc... copyright law and at least one international treaty on copyrights (the Berne Convention on copyrights).

My view is - if a friend said can i borrow a DVD to watch would that be against the law, i think not, so Torrents r the same, but with distant friends!!
