I am on unsupervised probation for 1 year in Tennesse for a misdeamenor shoplifting charge. I met with my Probation officer for the first time 10 days ago, and he gave me a list of rules to follow, including NO drinking, NO drugs, cannot possess alcohol, may be drug tested, and other things. He never actually told me he will drug test me, but he did say I could not drink or do drugs.
My charge has nothing to do with Drugs or Alcohol, so it makes no sense to be tested.
Is he telling me this to scare me, or is it a good chance he will drug test me for no reason next time I see him? (5 days from now)
I could not have passed a drug test when I first saw him (Weed) And still can't (have stopped 10 days ago)
So basically,
Will they drug test me?
If they do and I fail, will I go to jail?

Well, excuse me to everyone who did not understand what I was saying.
1. I only found out 10 days ago I was on Probation
2. I have not smoked since
3. I have not drank since
4. It can take up to a month to clear your system; I do not have a month
5. I HAVE learned my lesson, and intend to follow the rules for the rest of my life
6. I only wondered if I had a chance to rid the weed from my system and follow the rules exactly before being punished for something I did before I was on Probation

if you get caught youll go to jail or juvie, depending on your age.

Yes it is possible that they could drug test you. In most cases it really depends on the probation officer and how busy he is and if he is a strict PO. If he is it's likely he will test you at some point. When they have a large number of cases they tend not to test too often on charges that did not originally include a drug offense.

Same goes for the testing positive...many times it is up to the PO whether they send you to jail or give you a warning sometimes they will give you more than one chance as long as it's only weed they are finding ....anything else forget it you'll be sitting in jail.

He can expect to go to jail. It's unclear what WILL happen. It's possible that he could be resentenced to the maximum allowed under Fl. law for the charge he was convicted of - and more likely given that this is a DUI case. Murderers can always plead mitigation (bad childhood, mental incapacity), drug dealers can plead drug addiction, thieves can plead poverty - but there are almost never desperate circumstances behind DUI, and never any measurable group of people who will support them. Rather than resentence, it's more likely that he will be allowed to continue on probation - but he may be remanded overnight as a punishment.

Yes it's possible (and quite probable) that you will be tested. The alcohol is gone from your system so that is good but I'm not sure about the drugs. I think it takes less than 30 days but I'm not completely sure. All I can advise is if he does test you when you next see him explain to him what you told us beforehand and he should be lenient on you. He will probably test you again the next time to be sure you've stayed true to your word and kept off both. If he does let you off the hook remember his kindness and don't ever slip up with him on another test or there will be nothing you can do or say that will help you. Good luck.

did it occur to you that if he said they may and you smoke anyway, you have a drug problem ? By the way here are guidlines for elimination ---- lite smoker 1-3 days -- moderate (4 times a week) 3-5 days ----heavy (daily ) 10 days--- heavy, chronic (5 + joints a day) 10 - 21 +days. one half of ingested weed is eliminated every 18 to 24 hours regardless of amount ingested.Once ceased elimination occurs at the same rate.

If you are on Unsupervised probation you'll never get tested. You have no one to report to anyways. It's not worth gambling though. You can drink but if you do drugs and do happened to get called in your probation can get provoked and you could get some jail time. He is scaring you but don't call his bluff. I did my internship with a P.O. office and they were way too busy to mess with unsupervised. A small town or county has time to play games so do yourself a favor. DON'T SMOKE

I was on probation for 6 months and the P.O never gave me a drug test. More than likely you wont get tested.

i had a buddy who was on probation and he was drug tested. basicay you answered your own question. he gave you a list of things that you have to follow. yes if you have drugs or alcohol in your system you go to jail.

Yes they can, and they will. More than once I am sure. If you fail the test then it violates your probation agreement and you could end up doing the probation time.

Yes - they can, and probably will, test you - ya better stop...It takes 4 weeks for weed to get out of your system. Weed is not soluble in water, so it can't be flushed through by drinking a bunch of water - it is soluble in fat, so when you smoke it stores in your fat cells for a few weeks. It stays in your hair for years. By using your hair, they can almost tell you what day you smoked it on.
