They have been together for 10 years and still are together, he is scared to leave her if he can not have custody of the child. They have 2 daughters together 1 is 4 (that is the one he wants) the other is 8 months. She is abusive towards the 4 yrs old. She yells and curses at her all the time. Spanks her for no reason. So can he take her away?

She don't abuse the 8 month old. Only the 4 year old. Since the 8 month old was born she doesn't pay any attetion to the 4 year old. She always says I wish I only had your sister and not you! That child doesn't deserve that.

He does want both of them, but she is only abusive to one of them. But he would like custody of both his children

He should report this to the police, what the mother is doing is child abuse and my guess is yes he can take her away. I strongly suggest that either you or your brother report this right away!

first off, I question the motive behind wanting only custody of one daughter and not both. any judge would question that as well. I assume that he does not want the difficulty of raising an infant and would rather have the older child that is already pottty trained and all. the real issue is that if their mother is abusive to the older one, why does he only want her and not both in order to protect the infant from an abusive mother? it should not be a matter of wanting to protect just one child, your brother should have the best interests of both his children in mind. if he can prove the abuse there is not much the mother can do to get custody (as long as there's nothing in his background that could be interpreted as his being an unfit parent). he needs to consider all his options. I seriously doubt he could get custody of the 4-yr-old but leave the 8-mo-old with the mother. it's both or none I'm afraid.

if she's abusive to the 4 yr old, it's only a matter of time before she's like that with the baby. how could he only ask for custody of one? that kind of seems like he's playing favorites. he should start proceedings and demand full custody of both kids and let the courts know of her abuse.

there are a lot of men that have custody of there children he just has to show proof to the judge and most likely he will get custody

i am sure with proof of the abuse that he most certianly could the only question is why does he only want the 4yr old instead of both. what is his reason for only wanting the older child
