I had a local tax guy do my taxes and he assured me that everything was going to be ok. Well I got audited and have to back pay the taxes. Can I take him to court and at the least get the fines and interest reimbursed?

You can sue anybody.

You need to be prepared to show that he was incompetent and not that you gave him incomplete or wrong information. If it is due to not having the right information from you, your on your own. If he truly screwed up, he should be responsible.

Certainly you can sue him. But how are you going to prove that the fault was his? If you got audited and your taxes increased, I would say that he tried to keep your tax bill down as well as he could.
I doubt you would have much luck in claiming that it was his fault for you getting audited. He probably just used the information YOU gave him.
On top of all that, it would take a healthy amount of fines and interest to make up for the expense of suing!

Yes, you can sue for the penalties and interest though that doesn't necessarily mean that you will collect. Most good tax preparers will voluntarily cover you for those amounts.

The tax is entirely up to you, however. The taxpayer is solely responsible for the accuracy of their tax returns under the law. A few tax preparers have used this to their advantage to avoid liability for the penalties and interest involved.
