you better work that out before you get married. Even if you're not directly liable for his liabilities prior to marriage, if they go after him, presumbly your funds will be commingled and therefore, they will be going after your household's assets.

If the only reason that he doesn't file tax returns is because his income is below the filing requirement amount then there's nothing to worry about. If he's not legally required to file there are no issues to contend with.

On the other hand if he's a tax cheat and you marry this fool, you're opening yourself up for a lifetime of misery and pain. Do NOT marry him until HE has resolved ALL of his tax issues and has made a firm commitment to keep it that way forever. If he refuses to make that commitment then you should drop your commitment to him. PERIOD! Your chance of a successful marriage with a tax cheat are zero.

My suggestions:
1. Keep your bank accounts separate
2. File your taxes as married filing separately to cover yourself
3. Get a pre-nup so that if anything goes wrong and the IRS comes after him then his liabilities don't become yours.

Please take the advice of some of the smarter posters here and don't marry this fool if he has unresolved tax issues. I have helped otherwise intelligent and successful women through innocent and injured spouse relief many times. It's no picnic! You stand to lose everything you have in an IRS action.

Nice to know it now before you marry the bum. I would speak with a tax attorney who knows about this stuff. You wouldn't be legally liable for anything he did before you married him, but I don't know about afterward. He may eventually be hit with a tax bill that could impact your bottom line in the family.

Every year I deal with a number of these type cases. My suggestion would be for you to go stand in the middle of the freeway at rush hour. That would be less painful. Love may be blind but it need not be stupid.
