If you are collecting unemployment you can't be fired, because you can't be working. This is called FRAUD. You can go to jail for this. He shouldn't fire you. He should turn you into the United States Government.

I'm a little confused. You don't get employment unless you are terminated, so you wouldn't be employed there any more anyway.

If you are saying the person collected u.c. during a temporary layoff, then the collection would be legal.

In most places in the US, an employer can terminate anyone at any time for any reason except things like their gender, race or religion. They don't have to give a reason.

An employer can fire you for any reason or no reason at all if you don't have an explicit employment contract. Most employment is considered "At Will" meaning that either party can terminate the relationship at any time without explanation or advance notice.

Collecting unemployment while working is a crime. If you're committing a crime you certainly can be fired.

if you claim the unemployment is from the same employer yes, otherwise he too will be charged with fraud and possible tax fraud. As will the person collecting unemployment and working at the same time.

If you are collecting against his job he can...not only can he but he should contact the unemmployment office and report the incident so the state can proscute.
