Soliders are trained to kill. So wouldnt that mean that every time they kill somone it would be pre-meditated murder. Thats crazy. what do you think?

The rules of engagement do not include killing innocent civilians. They do not even allow you to kill the enemy if he is disarmed and in your custody. You can only kill him when he is trying to killl you. War is not carte blanche for wanton killing.

When i was in the situation i didn't give it much thought so i guess that would not make it pre meditated. I didn't find the article of which you spoke so not sure of the details and why he is being charged for pre meditated murder. If you are talking about the case which involves SGT. Evan Vela and two other soldiers if the facts presented so far are true then that would be pre meditated.

But there are Rule's of Engagement that have to be followed, and even if they are sometimes the victims families can have sympathy from news organizations which bring in the politics of war.

After all there was no war crime's on the Nuke's dropped at the end of WWII like there would be with our current rule's of engagement....

I'd support the soldier if it's a he said she said, but if the facts show hard evidence it is possible to be charged with that crime...

there are rules to war. a number of covention treaties that we follow. while it is difficult to judge a soldier or marine who may kill a non-combatant during a military engagement it is not the same as when civilains get pulled out of bed lined up against the wall and shot by our troops. wars bring out the worst in people. sadly sometimes the pressure and stress causes people to cross the line.

A soldier is also taught the "Rules of Engagement".

The shooting of any unarmed civilians is murder.

Technically premeditated murder of a civilian in a war is a war crime.
