I live in a Apt with my husband and not sure which building this guy lives in, but he has been making me feel scared and very uncomfortable to where I keep asking my husband if we are going to move to another Apt or rather we are buying a condo anytime soon. I've lived here in this Apt since 2004 and I take out the trash whenever it get full and I've never had any incident with any neighbors. Then, one evening, I just had to take out the trash because I threw something that stunk. As I was coming back from the trash and approached my Apt buidling I didn't see this guy at first, but he all of a sudden came out behind the staircase, which was dark. As he stood there, there were no facial expression, but a blank stare starring right back at me so I froze too. The thing was, to get back to my Apt I had to walk right by him .. inches away. I figured I should just keep walking and if he grabbed me I would scream and fight back.

Recently, I was unloading bags of groceries and I was about to climb the stairs
to get to my Apt and this same guy was going down the same stairs. As he was walking down the stairs approaching me he had no facial expression whatsoever except for that blank stare just starring right at me. Instead of showing this guy that I was afaird I challenged him and stared right back into his eyes. Today, as I was driving into the Apt complex, this guy happened to leave and he just starred the same way like he did with the other two occassions. What can I do if he decides to attack me? Has anyone else ever had a creepy guy just creeped you out? What did you do? I told my husband about it many times, but doesn't say anything except that I'm taking this way too seriously. I'm just trying to look out for myself because I don't want to put myself in a situation where this guy decides to knock me out, rape me and even worse get pregnant with his child.

I wasn't sure which category I was suppose to put this under and since this does sort of relate to law enforcement (police) what can you tell me on what precautions that I can take and what not? I'm dealing with a male, Indian guy in his mid 30's to early 40's. I've met really nice Indian tenants here at my Apt, but this guy seems to be giving me problems. Also, I know it differs State by State, but what jursdiction is there in the State of California? Like, what can I do to prevent from an attack if he decides to attack me out of the blue? Serious answers only please.

Here is what the law is concerning self defense in the State of California. I took it from this link. Its an official CA state document.
http://ag.ca.gov/firearms/forms/pdf/Cfl2007.pdf
It applies to any force you use against an attacker. Do what you need to do to stay alive.
3. THE USE OF FIREARMS IN DEFENSE OF LIFE AND PROPERTY
The question of whether use of a firearm is justified for self-defense cannot be reduced to a simple list of factors. This section is based on the instructions generally given to the jury in a criminal case where self-defense is claimed and illustrates the general rules regarding use of firearms in selfdefense.
Use of a Firearm or Other Deadly Force in Defense of Life and Body The killing of one person by another may be justifiable when necessary to resist the attempt to commit a forcible and life-threatening crime, provided that a reasonable person in the same or
similar situation would believe that
(a) the person killed intended to commit a forcible and lifethreatening crime;
(b) there was imminent danger of such crime being accomplished; and
(c) the person acted under the belief that such force was necessary to save himself or herself or another from death or a forcible and life-threatening crime.
Murder, mayhem, rape, and robbery are examples of forcible and life-threatening crimes.
Self-Defense Against Assault It is lawful for a person being assaulted to defend himself or herself from attack if he or she has reasonable grounds for believing, and does in fact believe, that he or she will suffer bodily injury. In doing so, he or she may use such force, up to deadly force, as a reasonable person in the same or similar circumstances would believe necessary to prevent great bodily injury or death. An assault with fists does not justify use of a deadly weapon in self-defense unless the person being assaulted believes, and a reasonable person in the same or similar circumstances would also believe, that the assault is likely to inflict great bodily injury. It is lawful for a person who has grounds for believing, and does in fact believe, that great bodily injury is about to be inflicted upon another to protect the victim from attack. In so doing, the person may use such force as reasonably necessary to prevent the injury.
Deadly force is only considered reasonable to prevent great bodily injury or death.
NOTE: The use of excessive force to counter an assault may result in civil or criminal penalties.
Im back:
Please be very careful carrying knives and other weapons. If you don't know what you're doing, its easy to take the your weapon away and use it on you. If you're very serious get some training.

I hope you are just over reacting. Maybe he's just a weirdo that stares too much. If you can find out his name, go to the county courthouse and see if you can find any public records on him. Although, just because he doesn't have a record doesnt' mean he won't do anything ever but if he has one you'll know you should definitely be concerned around him. I think you are being paranoid though, he's probably just in lala land day dreaming as you walk by.

You might want to consider carrying some pepper spray.
This guy sounds like a stalker.
I would also speak to the apartment manager and let them know what the situation is.
And since your husband doesn't think there is a problem, make him take out the trash.

Buy a little pocket pistol, a 22cal is enough, and keep it with you whenever your husband is not around and you have to go outdoors.
If you are assaulted, it takes the police minimum 20 minutes to respond, that's only if you can get to a phone to call them!
Be prepared to defend yourself.

Take a self defense course and it will give you piece of mind. When seeing this again again, make no eye contact, no commetns, give him a wide birht without him knowing it, ignore him! If attacked kick his butt!

seems to me it could be better for you to try to say something, perhaps he is trying to play the game with your mental health, or some experiment...from your question I can see that you are strong, concentrated...good luck
