Illegal. Its still selling drugs. Not a narcotic, but, selling any drug without proper permits or insurance is not legal. Plus if someone gets sick, they will drop dime on you and not only sue, you could get jammed up on assault and all kinds of stuff depending on the extent. And that includes someone taking too much and having to go to the school nurse.

Selling caffeine is not illegal. It is not a controlled substance. Depending on how and where the transaction was completed may violate local or state commerce laws and someone could violate various tax laws, but unless someone was hurt from using the stuff no one is going to enforce it.

As a law enforcement officer I couldn't even confiscate the stuff.

Illegal no. Will it get him in some serious **** until the cops find out what it is? Yes. I wouldn't do it. Hell $20 on 8 cents who can blame him though.

Yes, it is illegal. Selling any kind of drug for a high of some kind alone is illegal.
